Effective for all services provided by LEXUP®, operated by YV Management Sdn Bhd
Due to the immediate expenditure of computational resources and the concurrent scheduling of human personnel upon order placement, all purchases of the Services are final. Fees are fully earned upon submission of your order and are non-refundable, subject strictly to the limited remedies outlined in this Policy.
Processing for automated, software-based transcription and translation commences instantaneously upon the upload and submission of your source materials (audio, video, or text files). Consequently, orders for automated Services cannot be canceled, reversed, or refunded under any circumstances, irrespective of the user’s satisfaction with the output or the quality of the original source material provided.
Once a human-verified transcription or manual translation project has been queued and assigned to a specialist, the allocation of labor is irrevocable, and the associated fees become strictly non-refundable. If a written cancellation request is received and acknowledged by the Company prior to the commencement of human assignment (as determined exclusively by the Company’s internal system logs), the Company may, at its absolute discretion, issue a partial account credit (not a monetary refund) for the human component of the service only. This credit is non-transferable, non-cashable, and subject to an expiry date determined by the Company.
The Company strives to maintain standard commercial accuracy for all human-verified and translated deliverables, contingent upon the provision of clear, intelligible source material. In the event you allege a material defect, substantial deviation from standard accuracy, or objective linguistic error in a manual deliverable, you must provide detailed written notice to the Company within three (3) business days of delivery.
Upon receipt of a timely and valid defect notice, your sole and exclusive remedy—and the Company’s maximum liability—shall be a complimentary, targeted revision of the specific disputed segments. Disagreements regarding subjective stylistic choices, contextual terminology, synonym preferences, regional dialect variations, or inaccuracies stemming from poor or ambiguous source material, do not constitute material defects and do not warrant revision or credit.
Any deviations from or waivers of this Policy are made entirely at the Company’s sole discretion on a case-by-case basis and shall not constitute a continuing waiver of this Policy for any past or future transactions.
This Policy and any disputes or claims arising out of or in connection with its subject matter shall be governed by and construed in accordance with the laws of Malaysia. By engaging the Services, you irrevocably agree that the courts of Malaysia shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Policy.
